Is Taxation Legal?

A poster named "Tall_Pat" at Glenn Beck's 9-12 Project website asked, "What is the law requiring U.S. citizen to pay Federal Income Tax"? The poster asked the question to refute our government's ability to tax Americans.

My response to his post was this:

This is an easy one, Tall_Pat. Our government has the legal ability to levy taxes as stated in the Constitution. You're asking the wrong question. Here's what the Constitution says:

Article I, Section 2
Representatives and direct taxes shall be apportioned among the several states which may be included within this union, according to their respective numbers, which shall be determined by adding to the whole number of free persons, including those bound to service for a term of years, and excluding Indians not taxed, three fifths of all other Persons.

Article I, Section 8
The Congress shall have power to lay and collect taxes, duties, imposts and excises, to pay the debts and provide for the common defense and general welfare of the United States; but all duties, imposts and excises shall be uniform throughout the United States

Article I, Section 9
No capitation, or other direct, tax shall be laid, unless in proportion to the census or enumeration herein before directed to be taken.

No tax or duty shall be laid on articles exported from any state.

Here's why you're asking the wrong question. The Constitution clearly states the right of the government to levy taxes to pay for our defense, operation of our government, and public services. The fact that we CAN be taxed is incontrovertible. The questions you should be asking are, "Why does the IRS still exist after its charter expired once Europe was rebuilt after World War II", "Why did Congress illegally abdicate its responsibility to print and regulate our currency to a private corporation called the Federal Reserve in 1913", and "Why does the Federal Reserve, the IRS, and the U.S. Treasury have illegal powers to use force against The People"? The answer to those questions will lead us all to freedom because the answer is that our government has been operating under a criminal enterprise since 1913. Once the Federal Reserve Act of 1913 is repealed as unconstitutional, then the Fed loses all of its illegal power and ill-gotten profits. We need a department like the IRS, but only as accountants, and they shouldn't have the power to use force against The People.

The 16th Amendment provides taxation of all income of individuals, but the date of this Amendment coincides with the Federal Reserve Act of 1913, and will need to be redefined after The People repeal the Federal Reserve Act. In fact, all laws and policies from 1913 to today need to be re-examined and repealed as necessary once the Federal Reserve Act is proclaimed unconstitutional.
